1. General information

These terms apply to sales made through the website. By placing an order, you confirm that you have read and accept them.

2. Products and services

We sell ceramic photos for crosses and funeral monuments and related memorial products. The photograph provided by the customer is processed, applied to a ceramic (porcelain) plaque by ceramic decal and fired at over 800°C. Each personalised product is made to order, according to the chosen photograph, shape and size.

Photo processing — restoration, colourisation of black-and-white images, retouching and cut-out — is included in the displayed price, at no extra cost. Before production, we send the final preview for your confirmation.

3. Conclusion of the contract

3.1. Technical steps

  1. choose the product, shape and size;
  2. upload the photograph and fit it within the outline of the shape (or choose to send it later, where this option is displayed);
  3. fill in the delivery details and choose the payment method;
  4. check the order summary and the displayed total;
  5. press the “Order with obligation to pay” button. For card payments, you are redirected to the secure Stripe page.

3.2. Correcting input errors

Until you press the button in step 5, you may change any field, the photograph, the shape or the size at any time. After the order is placed, you may ask us for corrections by email or phone, until the preview is confirmed.

3.3. When the contract is concluded

The contract is concluded when you receive the order confirmation email; for card payments, after the payment is confirmed. If you did not provide an email address, the contract is concluded upon telephone confirmation of the order.

3.4. Storage of the contract

We keep the order in electronic format. The confirmation email contains the order details and links to these terms, the Returns policy and the Delivery policy; we recommend that you keep it. On request, we will send you again the terms in force on the date of the order.

3.5. Language of the contract

The contract may be concluded in Romanian or in the language of the website version used for the order. In the event of any discrepancy, the Romanian version prevails, without restricting the rights granted to you by the law of your country of residence.

4. Prices and payment

The price is the one displayed on the website at the time the order is placed and is the final price of the product. TOP GUIDE S.R.L. is not registered for VAT purposes, so prices do not include VAT and no VAT is added at payment.

For deliveries in Romania, the delivery cost of 19 lei is added to the product price and shown separately before confirmation. For deliveries in the European Union, shipping is included in the displayed price.

Payment methods:

  • Cash on delivery — in cash or by card, to the courier (Romania only);
  • Online card payment, via Stripe — in Romania and in the European Union; orders delivered outside Romania can only be paid online. Card details never reach our servers.

5. Delivery

We deliver in Romania within 3–7 working days and to the European Union countries listed in the Delivery policy within 7–14 working days. The delivery time includes photo processing and runs from the confirmation of the preview.

6. Right of withdrawal

Personalised products (made according to the customer's photograph and specifications) are exempt from the 14-day right of withdrawal, under Article 16(c) of OUG no. 34/2014 (transposing Directive 2011/83/EU). For non-personalised products, the 14-calendar-day right of withdrawal applies in full. The procedure, the return address and the model withdrawal form are set out in the Returns and refunds policy.

7. Guarantee

All products, including personalised ones, benefit from the 2-year legal guarantee of conformity from delivery, under OUG no. 140/2021 (transposing Directive (EU) 2019/771). In the case of a non-conforming product, you are entitled, free of charge, to have the product remade and, if this is not possible, to a price reduction or to termination of the contract with a full refund. 8. Photographs provided

The customer is responsible for the photographs and texts sent and declares that they have the right to use them. We use the photographs exclusively to fulfil the order; we do not publish them without the customer's explicit consent.

9. Data protection

Personal data are processed in accordance with the Privacy policy, the GDPR policy and Regulation (EU) 2016/679.

10. Applicable law and disputes

The contract is governed by Romanian law, including Law no. 365/2002 on electronic commerce and OUG no. 34/2014, without depriving you of the protection afforded by the mandatory provisions of the law of your country of residence. Disputes are settled amicably or, failing that, by the competent courts.
